When an arrested individual provides your phone number during jail booking, you are not automatically financially or legally liable for their defense or bail.

• Recorded Inmate Calls: Every jail intake phone call is audio-recorded and subject to prosecutorial subpoena. Never discuss the facts or defenses of the alleged offense on jail phones.
• Cosigner (Indemnitor) Caution: Signing a bail bond contract makes you personally responsible for the full $15,000+ bail amount if the defendant misses court, plus recovery and bounty fees.
• 48-Hour Arraignment Rule: Under County of Riverside v. McLaughlin, warrantless detentions require judicial probable cause determination within 48 hours.

Immediate 5-Step Custody Protocol

• Step 1: Obtain Booking Details: Secure the detainee's exact legal full name, date of birth, booking #, and specific facility name.
• Step 2: Check Hold & Warrant Status: Confirm there are no probation detainers, ICE holds, or out-of-county fugitive warrants that preclude release.
• Step 3: Evaluate Bond vs. Cash Deposit: A cash bond deposited directly with the court clerk is refundable upon case completion; bondsman premiums (8-10%) are non-refundable.
• Step 4: Retain Licensed Criminal Defense: Advise the detainee to invoke their 5th and 6th Amendment rights until counsel is physically present.
