The "One-Bite Rule" vs. Strict Liability
State laws vary significantly in how animal attacks are handled:
- Strict Liability States: The owner is liable for bite damages regardless of whether the dog ever displayed prior viciousness.
- Negligence / One-Bite States: The claimant must show the owner knew or reasonably should have known the dog was dangerous (prior bites, lunging, aggressive citations).
- Local Leash Ordinances: A leash law violation often constitutes negligence per se.
