Burden of Proof Thresholds
Presumption of Sanity
The defendant is initially presumed sane. The defense must introduce some credible evidence of mental disease/defect to raise the issue.
Prosecution Burden Beyond Reasonable Doubt
Once the defense presents sufficient evidence of insanity, the burden shifts entirely to the Commonwealth to prove beyond a reasonable doubt that the defendant was criminally responsible at the exact time of the offense.
