When a foreign national is booked into local law enforcement custody, ICE Enforcement and Removal Operations (ERO) issues an administrative request (Form I-247A) requesting the local agency maintain custody for up to 48 hours beyond normal release time.

Statutory Limit & Rule Strict 48-Hour Cap (excluding Saturdays, Sundays, and federal holidays). Detention past 48h creates potential 4th Amendment liability under Morales v. Chadbourne.
Defense Counsel Action Post local criminal bond immediately; serve local sheriff with 48-hour expiration notice; demand immediate release if ICE fails to physical take custody.
Burden & Standard Probable cause of alienage and deportability based on biometric IDENT/LESC hit or sworn officer interview.
