King Postpones Pardon Bid Decision Breaking Notice

His Majesty the Yang di-Pertuan Agong has formally deferred determination regarding the royal pardon petition by former Prime Minister Najib Razak, pending further legal consultation and assessment of ongoing trial proceedings.

ARTICLE 42 CONSTITUTIONAL PREROGATIVE SIMULATOR Federal Constitution of Malaysia
"Article 42(1): The Yang di-Pertuan Agong has power to grant pardons, reprieves and respites in respect of all offences which have been tried by court-martial and all offences committed in the Federal Territories of Kuala Lumpur, Labuan and Putrajaya..."

Under established legal doctrine (including Superintendent of Pudu Prison v. Sim Kie Chon), the prerogative of mercy is non-justiciable and solely at the discretion of the Monarch. The King is advised by the Board, but the final determination rests with the Crown.
