His Majesty the Yang di-Pertuan Agong has formally deferred determination regarding the royal pardon petition by former Prime Minister Najib Razak, pending further legal consultation and assessment of ongoing trial proceedings.
Under established legal doctrine (including Superintendent of Pudu Prison v. Sim Kie Chon), the prerogative of mercy is non-justiciable and solely at the discretion of the Monarch. The King is advised by the Board, but the final determination rests with the Crown.
Mandatory consultation mechanism: Before tendering advice, the Board must consider any written opinion delivered by the Attorney General (Article 42(9)).
