Statutory Enhancement Mechanics (NY Penal Law)

How Class A Misdemeanors Elevate to Class E Felonies

Under New York law, falsifying business records alone constitutes a misdemeanor. To establish felony liability under § 175.10, prosecutors must prove an intent to commit or conceal another underlying crime.

NY PL § 175.05
Base Misdemeanor (Class A): Making or causing a false entry in the business records of an enterprise with intent to defraud.
NY PL § 175.10
Felony Enhancement (Class E): The person commits § 175.05 AND the primary intent to defraud includes an intent to commit another crime or to aid or conceal the commission thereof (e.g. NY Election Law § 17-152 conspiracy, FECA limits, or tax law).
