RESOLUTION OF MLS BOARD OF DIRECTORS:
RESTRICTION OF PARTICIPANT PRODUCTION METRICS IN THIRD-PARTY RECRUITMENT FEEDS
WHEREAS, Section 7.58 of the National Association of REALTORS® MLS Policy establishes that an MLS Participant's listing and closed production data may only be syndicated with explicit authorization;
NOW, THEREFORE, BE IT RESOLVED:
1. COMMERCIAL RECRUITMENT DATA EXCLUSION:
The MLS shall immediately prohibit the licensing, syndication, or automated transmission of closed transaction agent-level production data to third-party broker recruiting platforms without affirmative written consent from the Designated Broker of Record.
2. RESO WEB API TOKEN SCOPE LIMITATION:
All vendor tokens granted under the MLS Data Licensing Agreement shall restrict queries against SoldPrice, ListAgentMlsId, and CoListAgentMlsId to authenticated Back-Office (BPO) feeds operated strictly for valuation, client servicing, or brokerage internal accounting.
3. CONSUMER DISPLAY IMMUNITY:
Public IDX and VOW feeds remain unaffected, maintaining consumer listing syndication and market discovery without degradation.
The Compass MLS Challenge
Compass formally petitioned major MLSs across the United States to block their listing and closed sales data from being packaged into third-party recruiting intelligence platforms like BrokerMetrics, Starmark, and Relitix. The argument: MLS feeds are funded by brokers to sell homes, not weaponized by rivals to poach top producers.
NAR Policy Statement 7.58
Under NAR MLS rules, MLS Participants retain proprietary compilation rights over their brokerage's historical sales roster. While IDX and VOW mandate broad consumer distribution, commercial data vendors operate under optional MLS licensing contracts subject to local Participant Board approval.
Brokerage Retention vs Transparency
Restricting recruitment feeds shields top-producing agents from aggressive poaching campaigns and preserves millions in brokerage commission revenue (GCI). However, open data advocates caution that excessive restrictions can impair consumer market analytics and broker bench-marking.
