How Music Publishing Deals Actually Work
Every musical composition consists of two equal halves: the Writer's Share (50%) and the Publisher's Share (50%). No matter what publishing deal is signed, Performing Rights Organizations (ASCAP, BMI, SESAC, PRS) pay the Writer's Share directly to the songwriter's bank account.
- Co-Publishing: The songwriter assigns 50% of the Publisher's Share to the publisher. The writer keeps 50% Writer + 25% Co-Pub = 75% Net.
- Administration (Admin): The writer retains 100% copyright ownership; the admin company takes an 8% to 20% commission to collect royalties globally.
- Full Publishing: The publisher takes 100% of the Publisher's Share, leaving the songwriter with 50% of total revenue.
Recoupment & Cross-Collateralization Mechanics
Publishing advances are unrecouped loans repaid exclusively from the writer's share of royalties. However, publishers can only recoup against revenue they collect—they cannot touch the writer's PRO performance check.
- Mechanicals & Sync: Fully recoupable against advances at the contractual split rate.
- Pipeline Lag: Royalties typically arrive 6 to 12 months after consumption (DSP streaming lag & foreign sub-publishing delays).
- Post-Recoupment: Once the advance equals zero, the songwriter begins receiving quarterly distributions for their publisher/co-pub share.
