Federal Sentencing Arithmetic: How a Prison Brawl Alters Release Dates

Under 18 U.S.C. § 3624(b), federal inmates serving terms over 1 year accrue up to 54 days of Good Conduct Time (GCT) per year of the imposed sentence. Under the First Step Act of 2018 (FSA), eligible minimum- and low-recidivism inmates can earn an additional 10 to 15 days of earned time credits (FTCs) for every 30 days of productive programming (28 C.F.R. § 523.40).

When an inmate is cited in a disciplinary incident (e.g., BOP Code 201: Fighting With Another Inmate), a Disciplinary Hearing Officer (DHO) operates under 28 C.F.R. § 541.3. A DHO can sanction the inmate with forfeiture of up to 27 days of accrued GCT (or up to 54 days for Greatest Severity Code 100 offenses) and place the inmate on a temporary disciplinary status that halts or suspends the accrual of FSA earned time credits, pushing the actual release date months into the future.
