In New York criminal practice, definite sentences (misdemeanors, petty larceny, city year terms) are served in NYC Department of Correction facilities (Rikers Island, MDC Manhattan, RMSC, etc.). Jail Time Credit (JTC) is strictly calculated pursuant to Penal Law § 70.30(3) from initial arrest/remand until sentence commencement, deducting any time credited to concurrent or previously satisfied sentences.
NY Penal Law § 70.30(3) â Jail Time Credit
The amount of time the defendant spent in custody prior to the commencement of such sentence as a result of the charge that culminated in the sentence shall be credited against the term of definite sentence.
NY Correction Law § 804 â Good Behavior Allowance
Every person confined in an institution serving a definite sentence may receive time allowances not exceeding in the aggregate one-third of the term imposed for good behavior and efficient performance of duties.
