Consecutive vs. Concurrent Stacking
Under NY Penal Law § 70.30, sentences imposed for distinct criminal transactions can run concurrently (merged together into the longest single term) or consecutively (added end-to-end). When terms run consecutively, statutory aggregate caps (e.g., 20, 30, or 50 years depending on felony class) restrict the maximum allowable time.
The 6/7ths Determinate Rule
For New York determinate violent felony convictions, the maximum statutory good behavior allowance is 1/7th of the imposed term (inmates serve at least 6/7ths, or 85.7% of the sentence). Under federal rules (18 U.S.C. § 3624(b)), federal inmates receive up to 54 days per year (approx. 85.2% served).
Pretrial Jail Time Credit (JTC)
Under NY CPL § 480.10, detention served before sentencing is credited against the minimum and maximum terms. When an individual has prior custody in a separate indictment or jurisdiction, multi-case credit rules dictate whether time is shared or credited exclusively to the first-commenced conviction.
